These Terms and Conditions (“Terms”) govern your access to and use of the Vitranos Fitness Index and any associated services provided by Vitranos Ltd (“Vitranos”, “we”, “us”, or “our”).

By purchasing, accessing or using the Vitranos Fitness Index, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Description of the Service

2.1 The Vitranos Fitness Index is a digital fitness benchmarking service.

2.2 The service includes:

  • Access to structured physical testing guidelines

  • Submission of user-provided performance data

  • Algorithmic scoring and benchmarking across fitness domains

  • Generation of a personalised Fitness Profile report

  • Structured prioritisation guidance based on submitted results

2.3 The service is delivered digitally and does not include in-person supervision, coaching, or medical oversight.

2.4 Vitranos reserves the right to update, modify, refine or improve the scoring methodology or report structure at any time.

3. Eligibility

3.1 You must be at least 18 years old to purchase and use this service.

3.2 By using this service, you confirm that:

  • You are legally capable of entering into a binding contract.

  • You are physically capable of undertaking light-to-moderate exercise.

4. Health & Medical Disclaimer

4.1 The Vitranos Fitness Index is provided for informational and educational purposes only.

4.2 It does not constitute:

  • Medical advice

  • Diagnosis

  • Treatment

  • Rehabilitation guidance

4.3 You should consult a qualified healthcare professional before participating if you:

  • Have a pre-existing medical condition

  • Are pregnant

  • Are recovering from injury

  • Have cardiovascular, respiratory, or musculoskeletal concerns

  • Have been advised to avoid physical exertion

4.4 Participation is voluntary and at your own risk.

 

5. Assumption of Risk

5.1 Physical activity involves inherent risks, including but not limited to:

  • Muscle strain

  • Joint injury

  • Cardiovascular events

  • Dizziness or fainting

5.2 By undertaking the tests, you:

  • Accept full responsibility for your participation

  • Confirm you are voluntarily engaging in physical activity

  • Release Vitranos from liability arising from participation, except where caused by negligence that cannot legally be excluded

 

6. User Obligations

You agree to:

  • Follow testing instructions carefully

  • Use appropriate equipment safely

  • Cease activity immediately if experiencing discomfort or pain

  • Submit accurate and honest data

Vitranos is not responsible for inaccurate reports resulting from incorrect data submission.

 

7. Payment & Digital Delivery

7.1 All payments must be made in full before access to the service is granted.

7.2 Once your results are submitted and processed, your personalised report will be delivered electronically to the email address provided.

7.3 Delivery is considered complete once the report has been successfully sent to your registered email address.

 

8. Refund Policy

8.1 The Vitranos Fitness Index is a personalised digital product.

8.2 Under UK Consumer Contracts Regulations, digital content that is personalised and delivered electronically may not be eligible for cancellation once delivery has begun.

8.3 By purchasing, you acknowledge that:

  • You request immediate processing of your order

  • You waive your statutory 14-day cooling-off period once the personalised report is generated

8.4 Refunds may be considered in cases of technical failure preventing delivery.

 

9. Intellectual Property

9.1 All materials provided, including:

  • Testing methodology

  • Scoring systems

  • Algorithms

  • Branding

  • Reports

  • Written content

are the intellectual property of Vitranos Ltd.

9.2 You may not:

  • Copy

  • Modify

  • Distribute

  • Resell

  • Reverse engineer

  • Republish

any part of the system without written consent.

 

10. Limitation of Liability

10.1 To the fullest extent permitted by law, Vitranos shall not be liable for:

  • Indirect or consequential loss

  • Loss of profits

  • Loss of business opportunity

  • Loss resulting from injury sustained during voluntary participation

10.2 Vitranos’ total liability shall not exceed the amount paid for the product.

10.3 Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot legally be excluded

 

11. Data Protection

11.1 Personal data is processed in accordance with our Privacy Policy.

11.2 By using the service, you consent to the collection and processing of personal data necessary to generate your Fitness Profile report.

 

12. Force Majeure

Vitranos shall not be liable for failure or delay in performance caused by circumstances beyond its reasonable control, including technical outages or third-party service disruptions.

  

13. Amendments

We reserve the right to update these Terms at any time. Updated Terms will be posted on our website and will apply to future purchases.

 

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
